Kirkby man leapt on woman and grabbed her throat

A Kirkby man forced his way into a woman's home, jumped on top of her and grabbed her by the throat after she refused to let him in, a court heard.

Jonathon Brown had started a relationship with the mum-of-two nine weeks earlier, but the court heard she didn’t want it to continue because he was “quite controlling.”

He repaid some money he owed her on July 5, and then returned to her address on Abbey Road, a short while later.

When she told him he couldn’t come in, he forced the door open, jumped on top of her and grabbed her by the throat, said prosecutor Robert Carr.

“She struggled to breathe,” he said. “She managed to kick Mr Brown off her and pushed him out. She asked a friend to call police.

“She described herself as being very frightened. It was the first time he had done anything like that and she says she is scared to stop at her address because of what he did.”

David Grant, mitigating, said: “He accepts that he was wrong and regrets he acted in the way he did.”

Brown, 25, of no fixed abode, admitted assault by beating, when he appeared at Mansfield Magistrates Court, on Wednesday.

District judge Jonathan Taaffe said: “This is domestic violence. It is violence that indicates to me that if you don’t get your own way, you explode.

“This could have resulted in a fatality. This lady must have been terrified. What saves you from an immediate prison sentence is your guilty plea.”

He gave Brown 12 weeks in prison, suspended for one year. Brown must also pay £85 costs, a government surcharge of £115, and compensation of £100.

He was banned from contacting the woman, or going to her address, for two years.
