Mum was twice over legal limit when she crashed car

A Polish woman was more than twice over the legal limit when she hit another car in Mansfield as she returned home from a night of heavy drinking.

Pauline Ewelina Malinowska, 29, of Milford Crescent, Mansfield, admitted driving with excess alcohol and driving without insurance or a proper license at Mansfield Magistrates’ Court on Wednesday.

The court heard Malinowska turned left on to Ladybrook Lane on June 4 and hit another car with her Seat Leon.

Lee Shepherd, prosecuting, said: “She was found sitting at the roadside. Her speech was slurred.”

Morgan Hogarth, mitigating, said Malinowska, a single mother, worked as a warehouse operative and had brought the Seat to drive to work with two co-workers who were qualified.

The night before the collision, he said, she had drunk a ‘substantial amount’ of alcohol.

“She believed that she would not be over the limit when she got behind the wheel,” said Mr Hogarth.

A roadside sample showed she had 89 microgrammes of alcohol on her breath, while a test at the police station showed 72 microgrammes, when the legal limit is 35 microgrammes in 100 millilitres of breath.

Mr Hogarth said this showed the ‘sample was coming down which is consistent with it bein historic drinking.’

The court heard she had a clean provisional licence, but stood to lose her job as a result of the automatic ban.

She was fined £170 for driving with excess alcohol and £70 for driving without the correct insurance. Magistrates ordered her to pay £85 costs and a victim surcharge of £30.

She was banned from driving for 22 months.
